Jurisdiction of the Szombathely Court
The designation of jurisdiction of the Szombathely Court (9700 Szombathely, Szily J. u. 7.) in legal and litigation matters arising within the territory of the European Union.
In connection with all contracts concluded through our webshop www.ecotrendwebshop.com and the legal relationships arising from them—including but not limited to the sale, delivery, payment of products, consumer protection disputes, warranty and guarantee issues, personal data processing, as well as matters related to intellectual property—we hereby designate the exclusive jurisdiction of the Szombathely Court for all legal and litigation matters arising within the entire territory of the European Union.
This means that in any dispute or legal controversy arising from the operation of our webshop or our services within any EU member state, the initiation and conduct of the proceedings fall exclusively under the jurisdiction of the Szombathely Court.
Furthermore, such matters specifically, but not exclusively, include:
• Claims related to breach of contract, such as compensation or contract termination claims due to defective or delayed product performance;
• Payment disputes, for example, arbitrary cancellation of orders or violation of payment terms;
• Consumer protection complaints and related proceedings where the consumer exercises rights to return products or get refunds;
• Data protection disputes, where the handling or protection of personal data does not comply with legal regulations;
• Intellectual property disputes, e.g., unauthorized use of product descriptions or images;
• Cross-border cases where the buyer originates from another member state but the dispute must be settled before the Szombathely Court.
By designating this exclusive jurisdiction, our aim is to ensure legal certainty for parties involved in potential disputes related to the webshop’s operation, facilitate the quick, efficient, and predictable processing of proceedings, and provide a clear and transparent legal environment for customers.
Accordingly, all clients, buyers, or legal representatives of www.ecotrendwebshop.com acknowledge that any litigation or non-litigation legal procedure related to the webshop’s activities falls under the jurisdiction of the Szombathely Court and must be initiated before this court.
